Our customer, a Latin America-based international law firm that advises local, regional, and international companies on country-specific corporate compliance, provides counsel and services in support of extraterritorial matters. These matters routinely range from white-collar Foreign Corruption Practices Act (FCPA) and Anti-Money Laundering (AML) investigations to civil cross-border and multi-jurisdictional litigation and arbitration. With a law firm of more than 65 attorneys and 20 tax advisors and a sporadic but intense workflow requiring advanced legal discovery technology to support time-sensitive audits, investigations, and litigation, our customer was interested in evaluating an alternative eDiscovery platform to replace their current technology. Given the nature of the support and the irregular intervals of intensive discovery, our customer not only required advanced eDiscovery technology but also needed a pricing model that allowed for periodic usage without penalizing them for episodical engagements. The hope of the firm’s corporate compliance practice lead attorney was that the alternative eDiscovery technology could be utilized as an immediate replacement and serve as a permanent part of the firm’s discovery resources.

The CloudNine customer support team also developed a complete pricing strategy and model to support the customer’s business need of economical and predictable pricing without the requirement for long-term, subscription pricing commitments.  

In a time frame of fewer than two weeks from initial conversation to an agreement to go forward, CloudNine listened to the customer’s needs, developed a technology and business offering to meet the customer’s needs, and informed, educated, and instructed the customer on the use of the CloudNine eDiscovery Platform.

Results

Upon successful demonstration of the eDiscovery platform and presentation of a simplified pricing model that would meet the customer’s needs and provide cost savings over the customer’s previous eDiscovery offering, the law firm selected CloudNine in early 2017 to replace its previous technology and provide eDiscovery support for its international corporate compliance practice.

CloudNine Receives Certification for EU-U.S. and Swiss-U.S. Privacy Shield Frameworks

Certification Strengthens CloudNine’s Data Privacy and Security Efforts

CloudNine, the eDiscovery Company (eDiscovery.co) which provides eDiscovery automation software and professional services for litigation, investigations, and audits, has received certification approval from the U.S. Department of Commerce’s International Trade Administration (ITA) for both the EU-U.S. and EU-Swiss Privacy Shield Frameworks. The Privacy Shield serves as the new legal framework by which data can be transferred from the EU and Switzerland to U.S. companies.

The EU-U.S. and Swiss-U.S. Privacy Shield Frameworks were designed by the U.S. Department of Commerce and the European Commission and Swiss Administration to provide companies on both sides of the Atlantic with a mechanism to comply with data protection requirements when transferring personal data from the European Union and Switzerland to the United States in support of transatlantic commerce.

On July 12, 2016, the European Commission deemed the EU-U.S. Privacy Shield Framework adequate to enable data transfers under EU law. On January 12, 2017, the Swiss Government announced the approval of the Swiss-U.S. Privacy Shield Framework as a valid legal mechanism to comply with Swiss requirements when transferring personal data from Switzerland to the United States. 

CloudNine’s certification approval provides our customers and partners with a number of important benefits to include:

  • The EU-U.S. and Swiss-U.S. Privacy Shield Frameworks were deemed adequate by the European Commission and Swiss Government respectively, meaning they are recognized mechanisms to comply with EU and Swiss data protection requirements when transferring personal data from the European Union and Switzerland to the United States in support of transatlantic commerce.
  • Participating organizations are deemed to provide “adequate” privacy protection, a requirement for the transfer of personal data outside of the European Union under the EU Data Protection Directive and outside of Switzerland under the Swiss Federal Act on Data Protection.

Pricing Models, Plans, and Services

With its simplified pricing, CloudNine offers customers two business models to support their legal discovery efforts. These models are Pay-Per-Use and Volume-Based Subscriptions. From these two models, CloudNine offers four pricing plans ranging from $35/GB/Month under the Pay-Per-Use model to as little as $12/GB/Month under the Volume-Based Subscription model.

Additional discounts may be available for multi-year commitments.

Advanced Services are available for $40/GB/Month with no minimum commitment under the Pay-Per-Use pricing model. The $40/GB/Month fee includes ALL Core Services as well as CloudNine Managed Productions and access to Relativity Hosting. Additional per seat user fees may apply for individual users of Relativity. CloudNine also offers Advanced Service subscription-based pricing beginning at the equivalent of $22.50/GB/Month at the minimum commitment level of six months decreasing to $16/GB/Month at higher volumes.
